Terms of Service

Welcome to Kazuki. The website kazuki-kollection.com (the "Site") is operated by KAZUKI, registered under SIRET number 93059104500016, with its registered office at 26 rue Jean Roque 13006, Marseille, France ("Kazuki", "we", "us"). Kazuki designs and handmakes upcycled and deadstock clothing and accessories in its Marseille atelier. The Site is hosted by Shopify.

These Terms of Service govern your use of the Site. Purchases are governed by our Terms of Sale, our Refund Policy and our Shipping Policy. If there is a conflict regarding an order, the Terms of Sale prevail. Nothing in these terms limits your rights under applicable consumer protection law.

1. Access and account

By using the Site, you confirm that you are of legal age or have the consent of a legal guardian. The information you provide (email, shipping and billing address) must be accurate and up to date. You are responsible for keeping your login details confidential and for all activity on your account.

2. Our products

Each piece is handmade from materials that have already lived a life: shirts, household linens, kimonos, vintage or deadstock fabrics. Upcycled pieces are usually one of a kind. They may show slight variations or small traces of their previous life (old seams, slight differences in shade), which are mentioned in the product description when visible. These features are part of our approach and are not defects.

We do our best to represent each piece accurately. Colours may however vary depending on your screen. Quantities of made-to-order pieces are limited by the fabric available.

3. Orders

Your order is an offer to purchase. It becomes final once payment is received and our confirmation email is sent. We may refuse or cancel an order for a legitimate reason (obvious pricing error, stock shortage, suspected fraud); any amount already paid is then refunded in full.

You have a 14-day right of withdrawal from the day you receive your order, under the conditions set out in our Terms of Sale and Refund Policy. In accordance with article L221-28 of the French Consumer Code, this right does not apply to pieces made to your specifications or clearly personalised (in particular our "Custom Made" creations).

4. Prices and payment

Prices are shown in euros, all taxes included. [Keep only one of the two statements: "VAT included" or "VAT not applicable, article 293 B of the French General Tax Code".] Shipping costs are shown before you confirm your order. The price charged is the price displayed when you place your order. Promotional offers are subject to their own terms.

5. Shipping

Delivery times are set out in our Shipping Policy and on the pages of made-to-order pieces. The risk of loss or damage passes to you when you, or a person you designate, take physical possession of the parcel, in accordance with article L216-4 of the French Consumer Code.

6. Legal guarantees

All our products are covered by the legal guarantee of conformity (articles L217-1 et seq. of the French Consumer Code) for 2 years from delivery, and by the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). The characteristics linked to the upcycled nature of the pieces, described in section 2, do not constitute a lack of conformity.

7. Intellectual property

The designs, the Kazuki brand, and the texts, photos, logos and visuals on the Site belong to Kazuki or to their authors. Any reproduction or commercial use without our written consent is prohibited. Buying a piece does not transfer any rights to its design.

8. Third-party tools and links

The Site may contain links or tools provided by third parties (payment, social media, reviews). We do not control their content and cannot be held responsible for it. Their use is subject to their own terms.

9. Relationship with Shopify

The Site runs on the Shopify platform. Sales are made directly between you and Kazuki; Shopify is not a party to the sales.

10. Personal data

How we collect and use your personal data is described in our Privacy Policy, in accordance with the General Data Protection Regulation (GDPR).

11. Reviews and content you share

If you send us a review, a photo or a suggestion, you allow us to use it free of charge to present our products, crediting at most your first name. You can ask us at any time to remove a photo or review concerning you. Your content must be honest and must not infringe anyone's rights.

12. Prohibited uses

You may not use the Site for unlawful or fraudulent purposes, interfere with its security or operation, introduce malicious code, collect other users' personal data, or copy its content (texts, photos, catalogue) on a large scale for commercial purposes.

13. Shopping assistants and automated agents

Shopping assistants and automated agents (including AI-based ones) may browse the Site and help a customer place an order, provided they identify themselves as such, do not circumvent security or verification measures, and do not overload the Site. We may restrict access for any agent that does not meet these conditions.

14. Liability

We do our best to keep the Site available and accurate, but cannot guarantee it will be free of interruptions or errors. We are not liable for indirect damage or damage caused by events beyond our control. This clause does not limit the legal guarantees or our liability where the law prohibits such limitation.

15. Account suspension

We may suspend access for a user who seriously breaches these terms, after notifying them where possible. Orders already confirmed will be fulfilled or refunded.

16. Governing law and disputes

These terms are governed by French law. If you have a concern, please contact us first at contact@kazuki-kollection.com and we will look for an amicable solution. Failing that, you may refer the matter free of charge to the consumer mediator we are registered with: [mediator name, address, website]. You retain the right to bring a claim before the competent court, including the court of your place of residence.

17. Language

These terms are available in French and English. In case of discrepancy, the French version prevails.

18. Changes

We may update these terms. The applicable version is the one published on this page on the day of your visit or order. Significant changes will be brought to your attention.
